Regulation in food supplements

Population is more and more interested by natural solution that explain the strong growth of the dietary supplements market. To better understand the products on the market and to impose quality rules, the regulation have been tightened.
Thus, since 2002, the (Directive 2002/46/EC) defines the framework of food supplements as foodstuffs whose purpose is to supplement a normal diet, which constitutes a concentrate source of nutrients or other nutrients having a nutritional, physiological effect in the form of doses.

REGULATORY TEXTS

For more than 20 years, regulatory texts have been drafted in order to harmonize the national and european market. Among these texts and devices:

  • The plant decree (June 24, 2014): 
    List of plants authorized in food supplements in France, classifying no less than 540 plants in order to certify the quality of the preparations used in food supplements by imposing a safety assessment on the entire production chain.
  • The claims regulation (regulation (EC) n°432/2012): 
    Lists the generic function claims. In the future, Synadiet wishes to set up a gradual classification of  pending plant claims in order to allow the use of claims with scientific evidence
  • The European nutrivigilance system (2009):
    Health monitoring system listing the adverse effects following the intake of food supplements, declared by health professionals.

LABELING OF FOOD SUPPLEMENTS

The person responsible for placing a product on the market is required to use compliant labeling in accordance with regulations (Regulation (EU) No 1169/2011).
The labeling rules for food supplements are the same of foodstuffs’s common, to which are addes certain particularities. There should be no statement suggesting that a balanced and varied diet is not an adequate source of nutrients in general, nor should food supplements claim the prevention or treatment of disease.

PLACING ON THE MARKET

Before being placed on the market, food supplements must be notified according to the decree 2006-352 which imposes: specific labelling, positive lists of plants and other substances that can be used in food supplements and the Maximum Daily Doses for nutrients.
